Frequently Asked Questions
Land
-
We consider a wide range of land that may have potential for residential development.
This could include garden land, infill plots, land adjoining existing properties, larger parcels of land or sites with existing buildings.
Every site is different, so if you’re unsure whether your land is suitable for development, we’d be happy to take an initial look.
-
No.
If we believe your land has development potential and we agree to proceed, Viva Lux will fund and manage the process of seeking planning permission as part of our agreement with you.
-
You don’t need to know before contacting us.
We’ll carry out an initial assessment, considering factors such as the location and size of the site, access, surrounding development, local planning policy and any potential constraints.
If we believe there is a viable opportunity, we’ll contact you to discuss the site and the potential next steps.
-
An option agreement is a legally binding agreement between a landowner and a potential purchaser. It gives the purchaser the right, but not the obligation, to purchase land within an agreed time frame and on agreed terms.
For Viva Lux, this gives us the time to pursue planning permission while you remain the legal owner of your land.
You will need to obtain independent legal advice before entering into an option agreement. We can recommend a suitable commercial solicitor if required and will cover your legal costs up to £2,500 plus VAT.
-
Viva Lux does.
Once an option agreement is in place, we fund the agreed costs associated with pursuing planning permission. Depending on the site, these may include planning and architectural services, surveys, specialist reports and planning application fees.
This means you don’t have to fund the planning process yourself while we explore the development potential of your land.
-
Yes. You remain the legal owner of your land while we pursue planning permission.
The option agreement gives Viva Lux the right to purchase the land within the agreed period, on the agreed terms; ownership does not transfer to us when the option agreement is signed.
Any eventual purchase would take place in accordance with the terms of the agreement.
-
Following our initial evaluation, we will arrange a site visit and work with our team of specialist planners and architects to explore a potential scheme for the site. Once this initial work has been completed, we will be in touch to discuss a potential offer. We may also ask for an indication of your expectations beforehand.
If we both agree to proceed, the basis on which the purchase price will be determined will be agreed with you before the option agreement is signed and clearly set out within the agreement. The amount you ultimately receive will be calculated in accordance with those agreed terms.
-
We will start marketing the opportunity to our network of developers during the planning application process, with the aim of having a buyer in place once planning is secured.
If planning permission is granted and a suitable buyer secured, we’ll move towards exercising our option and purchasing the land in accordance with the terms of our agreement.
If a suitable buyer cannot be found, Viva Lux may choose not to exercise the option. In this case you will retain ownership of your land and the benefit of the planning permission secured, subject to the terms of the option agreement.
-
Planning permission can never be guaranteed.
If an application is unsuccessful, we’ll consider the reasons for the decision and whether there is a viable route forward. Depending on the circumstances, this could include revising the proposals, submitting a further application, or considering an appeal.
If we decide not to pursue the opportunity further, Viva Lux may withdraw in accordance with the terms of the option agreement and you will retain ownership of your land.
